ANONYMOUS SPEAKS: Pork Barrel Scam (Updated)
I was reading my news feed at Facebook when I chanced upon a blog shared by my niece. Her only comment was "COMMENTS SECTION".

As curious as a cat, I clicked the accompanying photo (above) and read the blog first, written by MommyJ.
She wrote her opinion on the Pork Barrel Scam involving the wealthy Janet Napoles and family. What took me by surprise are the various comments from Anonymous which are like bombs that shattered my peace.

I am not pretty sure whether Anonymous (the first one who fanned the flame) is the same person who revealed classified information all throughout MommyJ's blog. For convenience, let me treat Anonymous as one and the same.

Janet Lim Napoles has strong ties before with the late Emilia Boncodin, DBM Secretary. Emilia is the one that keep Janet in the loop whenever a budget or SARO is approved and to which senator or congressman.

Gringo Honasan is a dear friend of Janet’s husband, Jimmy Napoles. I was surprised when I read somewhere online when Honasan was interviewed and he said that he doesnt know the Napoles family.
During the coup in Cory’s time, Jimmy napoles was driving a tank on the way to camp crame when he’s tank was hit by a mortar.Jimmy is operating the .50 caliber machine gun and the soldier driving the tank died during the blast. Jimmy survived and was jailed along with Honasan. If you can get clear photos of Jimmy Napoles online, you will see that part of his face and his arms show burn marks.

Their wealth started to build up during the late 90′s when they engaged themselves with mayors based in zamboanga to use them as a front for a Foundation that will implement projects or deliver farm materials. With connections at COA, they were able to arrange “completed projects” without delivering anything. They established JLN group of companies sometime in 2000 and they moved to their new office from AFPOVAI to Discovery Suites on the 25th floor.

Soon enough, they were able to develop deep connections with more legislators in congress and numerous senators. What JLN Group Of Companies do and their sub-companie, Jo-Chris Trading (named after their eldest child, Jo-Christine “Neneng” Napoles) – they use their foundations as the implementing agency for the funds of congressmen or senators. You see, congressmen and senators have budget, PDAF or the “pork barrel”, but these politicians do not have direct access to their funds and they can never touch it. So what they do is the politicians will create a project (common one is “fertilizer distribution” to farmers) and will ask DBM to set the budget. Then, there will be a public bidding to be held by DAR. The outcome of the bidding is already fixed and it’s Napoles foundation wins. The fund or SARO will be released through Janet’s foundation and the congressmen/senators will ask 70% of the whole amount. So if the project is 10M, Janet will give 70% of that. Usually Janet’s nephew, John Francisco Lim is the courier of the money, they will meet at Podium or at a parking lot. The money are stored in plastic bags or paper bags.

So, whatever is left from the budget, 30% goes to Janet. They usually cash-in the cheque they get from DBM at Landbank in Greenhills and the manager there is part of Janet’s payroll. Janet also need to pay the inspectors from COA and whoever is involved in DAR.

This is their workflow.This is what they do for more than a decade. This is how the senators and congressmen make money. This is why theses politicians have so much and working class filipinos almost have nothing. This is not only Janet’s fault. The greediness of the senators and congressmen are the driving point that keeps this system operating. It is also amazing that if Janet’s family and her company goes into trial, the people who will try them – judges, senators, congressmen, are also part of this. I fear for the life of Benhur and Merlina as whistleblowers. Soon enough they will die. The people of the philippines should protect them. NBI or the witness protection program cannot do anything about it. Because they are keeping the whistleblowers alive for their own use only. Once Janet give payments to the NBI and once Revilla, Honasan, Arroyo, Pichay, Ducut, Pineda, Lim, Estrada, Soto, Lapid, and almost all the congressmen who were in post for the past decade, step in – there’s nothing benhur or merlina can do. They are as good as dead by now.

Please post this on your social media and share it to the world. It is time to stop this madness and remove the pork barrel and protect benhur and merlina.

I was like, "What???" And I reposted MommyJ's blog in my FB wall, asking my friends whether it was true. The succeeding comments in MommyJ's blog contained warnings, words of caution, more expression of disgust to corruption. Some urged him to go to Philippine media to which he responded:

They also have strong ties with the Ampatuans in the south and yes, they also benefited from Janet’s company. Previous PNP chiefs during the Arroyo administration also used JLN Corporation as the foundation to supply communication radios initially valued at Php5,000 only to be listed in the receipt given to COA valued at Php65,000 each.

Let’s stop and reflect, if the local media publishes these facts, do you think that the current government CAN do something? NO. even if noynoy wants to punish Janet and even if he’s the president of the country, he can only do as much because our constitution does not allow the president to tackle these crimes. because that is not included in his job description. It’s a pity that people accuse the president of doing nothing. Yes, he cannot do anything about it because our law doesnt allow him too. You want something to be done with this issue? If noynoy declares martial law and will have complete authority over these issues, yes, he can hang all the senators and congressmen. But will noynoy declare martial law? No. not because the people of the country doesnt want to – its because noynoy wont bring back the years that caused his father’s death.

The current situation in the country has reach an impasse. unless the people do something about this, we will remain right where marcos left off – corruption everywhere and escalation of poverty.

It was overwhelming now for me. Though some informations were incredible, many were amazed by the details contained in Anonymous' narration. One thought that Anonymous is an insider to the Napoleses' lair. Others questioned his anonymity while others hailed him for his exposé.

Anonymous dropped some more bombs. This time, the name of one well-known media personality was mentioned.

I saw an interview of janet, jimmy and two of their children, jo-christine and his younger brother. The interview was conducted by Korina Sanchez. I was amazed how Korina played on the set and in a very sublime manner, projected the Napoles family as a victim.

Let me explain.

Korina is married to Mar Roxas. Mar is from Iloilo and he has a cousin, Johnny Roxas. Johnny stands 6’2, fair, brown hair and brown eyes. Johnny is a good looking male and a mestizo. Johnny used to work at JLN Corp. and he used his connections through Mar when he was still “Mr. Palengke.” Johnny earned significant amount of money by closing deals and getting the SARO of some congressmen and mayors and governors with the help of Mar. But Johnny had a fallout with Janet when some some cash commissions were not equally divided to him. He was also hoping to have a Mercedes Benz as a incentive from one of his successful transactions from a congressman based in Samar, bur Janet failed to deliver the car to him. Johnny soon left the company upset. Nevertheless, Johnny left JLN with few million pesos richer, and Mar Roxas a few million above 10M richer. Johnny Roxas became visible again in the political arena when he joined the campaign camp of Fernando Poe Jr. He was always visible on TV appearances and newspaper photos sitting or standing beside or behind Poe. With this said, Mar Roxas has ties with Napoles and that explains the interview with Korina that appears to be biased with the Napoles’. And you now know the reason why.

If you know your stuff, Mar Roxas does not have a cousin named Johnny Roxas. He only has 1 cousin and Johnny is not the name.

The Araneta-Roxas clan is worth so much more money, what is 10 million pesos to them? Magnanakaw ka na lang, bakit yang kakapiranggot pa na hindi man lang mararamdaman ni Mar. Magkano ba kinikita nila sa Araneta Center pa lang, sa Pizza Hut, sa Dairy Queen, sa Cibo, Cafe Bola, Sachi?

I believe there was a scam, but I don’t think you should drag other people in this controversy. If you really do know so much stuff, why not be an anonymous source for the NBI?

I dont have social media presence nor in the internet. My only platform is through this blog – your blog. I don’t even know you and perhaps you will never know either. As long as i am still alive, I will post on this blog if you dont mind. Thanks for doing sharing your blog to your social media nonetheless.

This news is slowly fading away and only a couple of local media outlets are currently covering it. The Revillames and Estradas are already preparing their speeches should this issue reach the senate. Some speculations in the current congress thinks that this issue is bigger than the corruption of Gloria Arroyo itself so everything is carefully planned out for the next step. There are extreme suggestions within the congressmen involved to create mass hysteria and stimulate “terrorism” activity in the city. They are planning to set off explosives in public places soon and will blame it to the Reds (CPP-NPA) organization.

Do you think that the Ayala Mall explosion before is an “accident”? How about the recent explosion in one of Ayala’s apartments in The Fort? Has anyone of you heard the case again and its updates? None.

It doesnt make sense, does it?

The Napoles lives in Ayala Alabang. Their house is adjacent to Ping Lacson. When Lacson bought the house in Alabang, this was the time when he and Erap were throwing accusations against each other. There was a news clip before of an interview to Lacson and he consistently denies that he does not have a house in an exclusive village. The Napoles’ was laughing hard because the family was the one who recommended that house to Ping.

As you can see, a significant number of residential owners in Ayala Alabang have sits in congress, senate, supreme court, mayors and governors. The Ayala’s are not in the position to deny these individuals who belong in the government from buying properties.

Imagine that at this very moment you are reading this and all the houses with owners that have sits in the govt disappear in thin air – how many house units will be left in Ayala Alabang? Let us say that ayala alabang will be like empty plots of land like in Fairview or Rizal. That is how significant these home owners are to the Ayalas.

How about Forbes? The Napoles have properties in Forbes Park as well. Who developed Forbes Park in the 70s? The Ayalas. And the same home owners in ayala alabang can be found in forbes park. The explosions in the ayala properties were no coincidence. They used it as a platform to divert the attention of the masses so that local media will cover the explosion news instead of corruption expose’ involving key individuals from the congress and senate during those times.

Now they will do it again soon. But this time, it will be exactly similar like the MRT bombings and bus bombings like before – they will bomb the public. Once this happen, all news will be focused on the bombings and slowly the Napoles and all the congressmen and senators, and judges, and secretaries, and undersecretaries will slowly crawl in the dark, away from all of us, together with all their wealth.

Oh, havent i mentioned that Jenny has already moved her money from landbank, metrobank, bpi, banco de oro and consolidated all of their accounts to HSBC hong kong recently? Ooooppss.

Those facts of blowing up buildings, bombing public transport and killing innocent civilians in the process is outrageous. Yes, it is beyond me how they do that. At what cost? Let’s do the math here and lets figure out why the philippines is still poor and why the congressmen, the senators will go as far as killing us all.

Currently, the philippine senate and congress is already drafting the budget for 2014 and it’s roughly Php2.3trillion. Yes, that is our country budget and that is made up of all the taxes that everyone paid. That is almost US$57.5B. That is a lot of zeros. Every year, the pork barrel allocates Php200M for EACH senator and Php70M for EACH member of the congress. There are:

24 Senators with 6-year terms maximum of 12-years
288 Members of Congress with 3-year terms maximum of 9-years
1 Senator x Php200M x 6yrs = Php1.2Billion per Senator for his full 6-year term.
1 Congressman x Php 70M x 3yrs = Php210M per Senator for his full 3-year term

Because all senators and congressmen are very patriotic and want to serve our country to their maxed out terms, let us do the math again:

Php1.2B x 2 = Php2.4B in 12-years pork barrel per senator
Php210M x 3 = Php630M in 9-years pork barrel per congressman

These are the amount of each senators and congressmen allocated to them in their respective tenures. Imagine the market value of this sector – the way Janet imagines it.

Because of companies like Janet, all the people that you vote use similar corporations like of Janet to steal money from the people’s coffer – from you, from us. Just imagine the huge amount once they’ve get a hold of their budget. Now think deeply why our country is still a mess. Can you now see the whole picture why our country is still poor? Why you, the reader of this blog, works so hard yet you save nothing?

This has been happening since the times of Marcos. The only difference is, during Ferdinand’s time, he’s the only thief and his cronies so the effect is the country doesn’t notice that they are “poor”. When Apo was ousted, EVERYONE sitting in power is a thief. Now the country can definitely feel poverty.
The figures listed above remain as the key motivator to Janet Napoles. That is why she is reach. That is why ALL members of the congress are filthy reach, That is why ALL senators are filthier. The sad fact is, there are numerous companies similar to Napoles that operates as we speak. Then why is Janet so popular? Because her company is generous to the greedy congressmen and senators, her company is the only one that can afford to give as high as 85% cash-on-hand off from their allocated budgets. Other companies similar to Jo-Chris Trading and JLN Corporation can only go as high as 65%.

Close your eyes now and imagine a senator gets 85% of Php2.4B. Now think about why ramon revilla – bong revilla, the arroyos, enrile, lacson, estradas and all of them are still in power, one generation to the other.

Open your eyes and reach to your pocket – how much do you have?

It hurts damn bad.

People in the internet challenges me if i have proof. No i do not.

But i can tell you that there are two metal safes inside JLN Corp.’s office at 2502 Discovery Suites in ortigas. One safe is inside Jimmy Napoles’ office and the other one is in Janet’s office. Their office also have a small storage room where all previous invoices and receipts that were never use during the past few years are being kept. If you, the reader can magically teleport yourself in that room, you will definitely find all the answers to your questions.

There is also a 5-drawer filing cabinet (metal and beige in color) in front of Janet’s office door where all files of each congressman, senators, mayors, governors, secretaries, undersecretaries, are nicely filed and named. Each folder contains copies of cheques, cash vouchers, petty cash vouchers, receipts of cash advances and bank account details for each transaction.

If by any chance that this blog has reached the Napoles family, they will move these safes and drawers outside their office ASAP. They will use the utility elevators located in the back of the building to transport the cabinets and all its contents. Once they reach the carpark, they will go to carpark slot number 1 to load these things. Janet owns carpark numbers 1, 2 and 3 at Discovery Suites. It is a good thing to also ask Jun Pareno, one of the big bosses of Discovery Suites, how he helps the Napoles family all throughout these years conducting VVIP services to some congressmen and senators as part of Janet’s perks to them using the hotel services.

Going back, those drawers will be moved in binan laguna in one of their houses there and everything will be burned. This has not happened yet. And if you, the readers, do nothing, once those drawers are out of the streets, there goes your evidence. Don’t let the local san juan police raid their office because that is part of their plan – to have the police storm their office and make it appear that everything is being seized. Of course, what safer way it is than to transport the cabinets escorted by law enforcement officers only to be burned after.

The Napoles speak fluent Chabakano.

They are rich because they do business in both sides – opposition and coalition. They started poor in the 70s – 80s selling packed lunch (similar to jolly-jeep) at the premises of AFP since Jimmy is a Marine. Officer.

I don’t have a single clue where the f*ck they get the idea that they are into the coal mining business.
Janet and the female owner of AM-Europharma are BFFs. That explains their mansions in Laguna because AM-Europharma’s factory is in Laguna.

Eddie Badeo is effing naive. Everything she said is spot on and correct. But, all martyrs die in the end.

There are three siblings in the Lim family, Ronald Francisco Lim, Janet Francisco Lim, Reynald “Jojo” Luy Lim. “Jojo” is a half brother and Benhur Luy is related to Reynald. That’s why they could not kill Benhur when they still have a chance. But now they all wish him dead.

Jo-Christine Napoles is a graduate from St. Benilde. Her brother, James Napoles is also from Benilde.
Benhur is as guilty as Janet – they both became rich helping politicians steal from us.

Merlina Sunas is still poor and helpless. Janet used her all throughout these years. Save Merlina and let Benhur die.

Patayin na natin lahat ng mga kongressman at senador! at bantayan na ang mga airport dahil tumatakas na sila isa isa!

This is just one of the many calls for murder and the likes. I do not subscribe to this idea but for the sake of telling the story, I am reposting. There were suggestions that they tell what they know to Rappler.com, CNN, and other trusted media personality.

Everyone wants to know the identities of the congressmen and senators and cabinet members and judges that have business relations with JLN Corp.

Simple.

There are numerous security cameras installed in Janet’s office and the recording machine is located in her room. You will see all the people that comes in and out of their office – including ALL the politicians in HD viewing.

If by any chance they have deleted it, the people of the philippines can ask Discovery Suites CCTV footage of their hotel entrance at the back of their building. Or the CCTV at the Serendipity Lounge. It is also interesting to check the CCTV footage of Landbank Ortigas and see how many times the employees of JLN come in and out in a day for the last five years. Or probably all CCTV at the banks in Greenhills (along ortigas avenue) because most probably, JLN Corp have accounts on them.

We might as well try CCTV footage at Starbucks and Dome Cafe at Podium. I am sure as hell that they will find videos there for the past 3 or more years.

But people, we better act fast because once they read this blog, those videos are good as gone.

I really don't know how much of Anonymous' story is true. But like someone who receives a bomb threat, I simply cannot ignore the warning.

At this point, the readers are thanking Anonymous. Some were thinking of another People Power Revolution out of disgust. There are suggestions of statehood (that the Philippines becomes the 51st USA state), change of charter, and others that are so bloody. One even called on the soldiers to start a bloody revolution! There is animosity among some readers due to conflicting ideas. But I realized while reading the comments, Philippines is indeed a free country. Crooks are free to rob as free as the citizens to be verbally hostile.

Going back to Anonymous, he is not done yet though he said, this one will be his last comment. He gave out some interesting info like an edited telephone number allegedly of Janet Napoles. He even linked the big telcos to this mess. He addressed the netizens, to wit:

JLN Corporation is only a small part of the structured embezzlement system established in this government. do you think that if all of us demand to “open janet’s bank accounts” will happen? No. Why? She’s is protected by law not to do it. Just like you and me. Like others that were in the same situation as her now – marcos, estrada, lacson, glorya, corona and countless politicians (well almost all of them) – this too shall pass. And she will be acquitted. I can see the web traffic on this blog and there’s a significant number of lawyers reading this comment at this very moment. And they know that I am right. Surprisingly, Janet is reading this blog right now, and you can just imagine her big smile painted on her face.

Why? Because the people you elected created a law that will protect them from us. And there is nothing that we can do. There is nothing that you can do. People power? Yes we can all march on Edsa and after that what? We will all be back where this issue left off – country will still be in poverty.

Let’s go back to the current issue. Janet’s company, JLN Corporation together with her family, serves only a fraction of what caused the poverty in this nation. She’s only a part of a hand that feeds the mouth and the whole body. Now, ponder this, IF the Napoles is put into prison at this very instant, and we recovered their wealth and put it back from the people’s coffer – now what? The same congressmen, senators, cabinet members, police chiefs, army chiefs, NBI chiefs, judges will start to steal again. Have we solved the root cause the nation’s problem? No.

You and I are angry at Janet. Yes, that is true. But consider this, Janet is only a facilitator. The beneficiaries of everything she stole goes back to the senators, congressmen, mayors, etc. And JLN Corporation is only ONE company that we are aware of. There are MANY companies and foundations out there that, members of the congress and senators operate. You think that enrile has no foundation similar to janet? Hell no, he got dozens. And also estrada, etc.

I want to state some facts here. Janet is still “poor” compare to the arroyos and macapagals. In fact, janet’s wealth doesn’t even come close to pandak. Pandak’s family has been plundering the nation since Diosdado’s time. How? That’s why Dado got rid off the americans because Dado wants absolute control of the country’s wealth. Similar to glorya, from VP to President to congress. They will fuck everyone just to stay with power. Why? Annual country budget in our country averages Php21Trillion. Imagine even if you can have 1% of that amount every year, will you not kill anyone that will stand in your way and fuck everyone else?

Now let’s go back. JLN corp and jo-chris trading accumulated wealth during the time of arroyo. And we all know for a fact that marcos’ wealth is puny compare to the collective wealth of the arroyos and macapagals. And during the time of arroyo, everyone steals from everybody and they made a killing. Do you think that with a company like Janet’s will not attract arroyo’s attention during her term?
Arroyo knows janet and glorya just let her run her business. Why? Arroyo was busy in bigger projects and Janet’s company breathes life to this ecosystem and keeps its liquidity. Janet’s company and other companies similar to hers keep things balance in this systematic scheme and organized plunder.

So people, if we want to be angry, let’s not be angry to one person only. No wonder) and mayors, and governors, and cabinet members and their undersecretaries.

To all the people who demand for trial and investigation, please stop, please. Nothing will come out of that investigation and please don’t fool yourselves that if you make a campaign to stop and abolish pork barrel and pork barrel will be gone – no, it will not happen. Never.

The philippines have already suffered enough. All our previous people power were all peaceful and look at ourselves now. We are still here and I am writing this piece.

The solution is a violent revolt against all members of congress and senate. Let their bodies hang on bridges and burn their houses. Once the purge is over, the government should hire a foreign consulting company that will handle the nation’s budget and rebuild this nation from ground up. It is a fact that we filipinos cannot govern our own selves, let’s face it. Once we see power and wealth within our grasps, we don’t fucking care anymore. This is the only way to restore our nation and to bring back countless OFWs abroad and start a new life for the current generation.

There is no other solution.

I don't have an Instagram account, there was no link to this claim, but thinking that this could be true, wouldn't you get angry at this scandal? At this point, I am not saying that these are all true. However, we know that somewhere right now, there are persons who are siphoning off money from the people's coffer. And what do they do with easy money? Invest in stocks? They also lavish their kids with luxuries! All these happen while many people are hungry and roofless. Not just kids, but some attorneys who are serving the privileged ones.

Each name here with its respective equivalent amount is only a summation of 2-4 months worth of transactions with JLN. We have not completed adding all receipts, documents, etc for the 2004-2011 period.

We are still not sure if we want to do this because we are tired already and pissed. you can now imagine the value of each representatives. Ask yourselves, how many months are there in total from 2004-2011?

I was once offered to create development projects using the PDAF of some senators, especially the reelectionists during the 2013 elections. That was between 2011-2012. The deal was: 60/40. That is 60% goes back to the senator to be used as campaign funds, and 40% goes to the ‘project’ and others. The ‘others’ here meant people who are involved in the transaction, which all in all they will get 20%. The project proponent gets 20% of the amount. The lowest amount offered was Php2 million. I initially entertained the offer. I submitted 3 project proposals with the total amount for funding of Php6 million. I foolishly involved three cooperatives with the intention that the 20% we’d receive would be used for the ‘real project.’

But there’s something that struck my senses when I brought the coop leaders to the Senate in June last year (2012) for a meeting with a senator and a couple of senate staff who would process the papers — that I could only be used by politicians as a pawn in their game. I was even introduced to Sandra Cam, the whistle blower that Lacson and Erap used against Gloria Arroyo. After the meeting I went straight back home and thought carefully about the consequences of my action. I decided not to pursue nor to follow it up. My conscience could not simply take it.

Even if the people would pressure Congress to remove the PDAF, legislators would not heed because it is necessary for them because their constituents would demand from them concrete, visible projects. But COA should demand full accountability; PDAF disbursements should be audited. After all its the public’s money and not to be used for discretionary by indiscreet politicians.

It seems that we, the people have a participation to this scam after all. It all starts from the bottom and magnified at the top. Sadly, very few of them are enjoying our money in contrast to the millions of Filipinos who are denied of basic services. See Anonymous' computations here:

I’m one of the ‘anonymous’ commenters. And I’m willing to share my story and experience about the 60/40 offer of PDAF misuse. I still have my project studies and people who could confirm my story. It should be an opportunity for investigative journalists to dig deeper into the issue. It is a ‘scandal’ that government should resolve.

Jeane Napoles and gifts for the super rich

 
MANILA - How much does one need to spend to give gifts to the super rich, like the daughter of businesswoman Janet Lim Napoles? 
Napoles, who has been implicated in the P10-billion pork barrel and Malampaya fund scandal, admitted giving her daughter, Jeane, a Porsche Cayenne and a Porsche Boxster.

A 2008 Porsche Cayenne costs between $21,385 and $42,503 (around P928,110 to P1,844,631), according to Yahoo! Autos.



A 2012 Porsche Boxster, meanwhile, will set you back between $48,100 and $65,200 (or around P2,087,541 to P2,829,682).
Here are price estimates of other gifts the young Napoles either bought, or were given as gifts by her parents:
  • YSL Tribute Leather sandals: $875 (P37,975)
  • Chanel timeless clutch: $1,900 (P82,460)
  • Hublot white Big Bang watch: starts at 11,400 euros (around P620,000)
  • Celine Medium Luggage Tote: $3,100 (P134,540)
  • Chanel watch: 4,000 euros (around P226,000)

The items do not include how much Napoles spent for her daughter's 21st glitzy birthday party held at a Beverly Hills hotel.

Other luxury items that her parents could have bought for Jeane are not also shown on her Instagram account, which she has deleted.

The older Napoles, in an interview with ABS-CBN News, has confirmed the authenticity of the cars and luxury items belonging to her daughter.

She said the money for the gifts came from her family's legitimate business ventures.

Napoles has been accused by several whisteblowers as being behind a public fund scam involving 5 senators, 23 congressmen and fake non-government organizations.

On Wednesday, one her mother's lawyers defended Jeane, who has received flak for flaunting her lavish lifestyle on social media.

In an interview with radio DZMM, Atty. Lorna Kapunan said Napoles' family is well-off because of their businesses abroad.

She said everyone should be proud of people like Jeane who excel in school.

Kapunan said she would also give expensive gifts to her children if they excel in school and if she had a lot of money from legitimate sources of income.

“I always say when I am asked, kung mayroon akong kayamanan ng kaunti at nakapag-magna cum laude ang aking anak sa isang US university, bibigyan ko din siya ng Porsche, bibigyan ko din siya ng Chanel kung afford ko. Citizen's arrest for Janet Lim-Napoles

MANILA, Philippines - The public was urged yesterday to carry out a "citizen's arrest" of Janet Lim-Napoles after the businesswoman apparently tipped off eluded lawmen Wednesday night.

Justice Secretary Leila de Lima said all regional and field offices of the National Bureau of Investigation (NBI) have been alerted to help the 12 special teams of the bureau created specifically to arrest Napoles and her brother Reynald Lim on the strength of a warrant issued by Makati City regional trial court Branch 150 Wednesday afternoon.

Napoles is now considered a “high profile fugitive,” De Lima said as she ordered immigration personnel to be on the lookout for the wanted siblings.

The arrest warrants were for the illegal detention case filed against Napoles and her brother by former employee and whistleblower Benhur Luy.

Napoles is at the center of a controversy over the alleged misuse of some P10 billion in pork barrel funds by some lawmakers reportedly through ghost non-government organizations she set up.
“It’s an agency-wide search and national in coverage… My instruction to the NBI is actually no letup in their manhunt operations. It’s a massive search,” De Lima told reporters in an interview.

Malacañang also appealed to the public to help authorities arrest Napoles and Lim.

De Lima said the NBI, which is under the Department of Justice (DOJ), has also coordinated with the Philippine National Police on serving the arrest warrants.

De Lima explained that the arrest warrants issued by Judge Elmo Alameda have the same effect as a hold departure order – meaning it effectively bars the subjects from leaving the country.

She added that both fugitives have been included in the BI’s lookout bulletin, which means the airports have been on alert for their possible flight even before the issuance of the arrest warrants.
With the Civil Aviation Authority of the Philippines alerted of the court order, even private aircraft are barred from taking the two fugitives as passengers.

Prosecutor General Claro Arellano, however, said they would still seek the issuance of a hold departure order (HDO) against Napoles and Lim, since their lawyers are expected to seek bail as well as the lifting of the arrest warrants.

The DOJ chief admitted that tracking Napoles is a challenge to authorities, considering her “resources and connections.”
She said Napoles had apparently been tipped off on the issuance of the warrants.

“We received a report that her lawyer was already waiting there at the Makati RTC even before the arrest warrant was released,” she said. “That’s the reason why the NBI immediately proceeded to the known addresses of the Napoleses, including that in Pacific Plaza and Dasmariñas Village (in Makati City) and others, after getting hold of copies of the arrest warrants, but they were not found in any of their addresses,” she said.

“We also received information that their vehicles were spotted going in and out of NCR (national capital region),” she added.
She said those who have information on the whereabouts of Napoles and Lim may call the NBI operations center at 524-1141 or 0917-5838612.

The DOJ chief has released a list as well as photographs of 30 vehicles that the fugitives may be using.

The list and the photos would be posted at tollbooths and security outposts at the North and South Luzon expressways. “Given the magnitude of the case, citizen’s arrest is possible,” she stressed. She appealed to Napoles and her brother to just surrender “and face this case and the cases to follow.”

NBI director Nonnatus Rojas said Napoles’ having several properties in Luzon and the Visayas is compounding the hunt for her and her brother. “That’s the difficulty if the subject has many assets and resources,” he said.

Documents obtained by The STAR show that Napoles has 22 properties registered in her name.

Why the rush?
Napoles’ lawyer Lorna Kapunan said she was wondering why the DOJ was in such a rush to have Napoles arrested, considering that the court had set a hearing on her motion to determine probable cause against her client.

“Why the haste? This case would deprive a person of her constitutional right to liberty. The DOJ could have waited a day or two or after the court has heard our motion before asking for the arrest warrants,” Kapunan said.

In filing a motion for the determination of probable cause, Kapunan said they were questioning the DOJ’s basis for reversing an earlier decision to dismiss the case of illegal detention filed against Napoles and Lim.

The motion was supposed to be heard by Judge Alameda at 8:30 a.m. today. But according to Alameda’s staff, the motion will no longer be heard as it is already considered moot with the issuance of the arrest warrants.

“What is the evidence that compelled her (Secretary De Lima) to reverse herself?” asked Kapunan. She said the evidence, comprising 17 sworn statements and closed circuit television (CCTV) footage, were “strong enough” to have the case of illegal detention against Napoles and Lim dismissed.

Kapunan added that Napoles’ lawyers were not furnished by the DOJ with a copy of its resolution reversing the previous dismissal of the illegal detention case.

Illegal detention under the Revised Penal Code is a non-bailable offense.

More arrests pushed
Administration lawmakers, meanwhile, urged authorities to also include other cohorts of Napoles in their hunt and ensure that all possible means of her escape are blocked.

Citizens’ Battle Against Corruption party-list Rep. Sherwin Tugna said the NBI should also run after her cohorts, particularly those in various government offices.

“For such a grand scheme like that, Napoles and her bogus NGOs could not have done it alone,” Tugna said.

He said the DOJ should also determine the accountability of its witnesses, whose intent to help may be questionable.

Cagayan de Oro Rep. Rufus Rodriguez, for his part, appealed to Napoles to surrender to authorities and defend herself. “She should come out of hiding, she should face the music,” he said.

“Flight is an admission of guilt, to me you are guilty if you run away from a case, so we appeal to Napoles to be able to be in the justice system by answering the kidnapping charges against her instead of hiding,” he said.

“How can she defend herself if she is in hiding? She cannot also defend the pork barrel scam so she should emerge,” Rodriguez said.
He said he believes the alleged kidnapping is only one of the many charges that could be filed against Napoles.

Family connection
Senators Jinggoy Estrada, Ramon Revilla Jr. and Ferdinand Marcos Jr. decried yesterday attempts by some quarters to establish aconnection between their children and those of Napoles.

In separate statements, the senators admitted knowing Napoles but only as an acquaintance.

Revilla made the revelation as he also tried to protect his son Bryan from being dragged into the pork barrel scam.

Revilla said he was introduced once or twice to Napoles, and had seen her occasionally in social gatherings.

According to Revilla, his son Bryan and one of Napoles’ children were schoolmates in high school. The two, along with other friends, had set up PB and J Corp. which is engaged in importing and selling rubber shoes.

The two lawyers of Janet Lim-Napoles claimed on Wednesday that the National Bureau of Investigation may have been unwittingly used to “save face” after the “fake” rescue  by its agents of Benhur Luy, principal whistle-blower in the alleged P10-billion scam.

The camp of Napoles is considering slapping libel charges against Luy and his family and the Inquirer for claiming she masterminded the scam involving pork barrel funds of lawmakers over the past 10 years.

“We don’t know if we will file a case against the Inquirer or the whistle-blowers,” Bruce Rivera, lawyer of Napoles, told reporters.
At this point, he said, the legal team was “still trying to explore the legal options available against of course all of the people involved who may have done something.”

Rivera, along with Alfredo Villamor, lawyer of Napoles’ brother Reynald “Jojo” Lim, held a news conference on Wednesday to turn the tables on Luy.

They said the Luy family’s vilification of their client was born out of their lost bid to have the siblings Napoles and Lim charged with the serious illegal detention of Luy for three months starting last December.

Rivera read a statement from Napoles in which she slammed the Inquirer for “vilifying” and “demonizing” her as she took exception to Wednesday’s banner headline where she had allegedly said she controlled the government.

“I wish this were true for if I really have the government in my hands, then the NBI would not have arrested my brother and charged with a criminal case since I would just tell Secretary (Leila) de Lima to back off,” Napoles said.

More denials
She denied she had misused the pork barrel funds of lawmakers through fake nongovernment organizations, saying she was a businesswoman with legitimate businesses.

Napoles described Luy as a “trusted relative” who used to do errands for her until December last year when she claimed he stole P300,000 that he was supposed to deposit in her bank account.

Her lawyers furnished reporters a copy of a June 25 resolution of the Pasig City Prosecutor’s Office charging Luy with qualified theft.
She also alleged that Luy had taken out a P5.5-million loan from Air Materiel Wing Savings and Loan Association Inc. without her authorization.

Blackmail
Napoles denied that she had detained Luy. She said Luy actually had gone on a spiritual retreat “to reform himself,” saying that he was “by his own admission a habitual user of the illegal drug ecstasy,” and had “gender confusion and sexual indiscretion issues.”

Napoles said the illegal detention case and the allegations of her being the brains behind the pork barrel scam were hatched by the Luys and their lawyer, Levito Baligod, so they could blackmail her.
Napoles said her lawyer Villamor met with Baligod who allegedly demanded initially P38 million in exchange for dropping the serious illegal detention case against her and her brother, later raising this to P300 million.

“On top of the P300 million, Attorney Baligod also demanded I facilitate the issuance of Canadian visas for the Luy family plus pocket money amounting to $1.5 million and the setting up of a pharmacy that will serve as the business of the youngest Luy sibling who is not going to Canada,” Napoles said.

“It is clear that extortion and blackmail are the motives behind the series of articles, which appeared in the Inquirer and was no doubt fed by unidentified NBI agents who are wittingly being used by Attorney Baligod and the Luy family for their own selfish needs,” she said.

Ready to face probe
At the news conference, Rivera said that Napoles was “ready to face any investigation” but lamented that she was being “targeted in the bar of public opinion without proof.”

The lawyer also dismissed as “statements which are without evidence, record or proof” the affidavits issued to the NBI against Napoles. “It’s unfair that (the statements) were taken as gospel truth,” Rivera said.

Villamor said the charges against Napoles only came out after the state prosecutor threw out the serious illegal detention case against her and Lim.

He quoted a portion of the June 10 resolution of Assistant State Prosecutor Juan Pedro Navera that stated Luy’s letter to Napoles apologizing for an offense he committed against her did not indicate he was illegally detained.

Napoles' brother tried to leave Philippines twice

MANILA, Philippines - The brother of businesswoman Janet Lim-Napoles who evaded arrest along with her on Wednesday had allegedly tried but failed to leave the country twice on the same day early this month, an official of the Bureau of Immigration (BI) said Thursday.

BI-Immigration Regulation Division chief Danilo Almeda said that Reynald Luy Lim allegedly tried to leave the country twice on Aug. 2, but was thwarted in his attempts by alert immigration officers at the Ninoy Aquino International Airport (NAIA) Terminal 1 who recognized him from the Lookout Bulletin Order (LBO) issued by the Department of Justice (DOJ).

Almeda said Lim tried unsuccessfully to leave the country on Asiana Airlines flight OZ 706 bound for Busan, South Korea on Aug. 2 at 10:19 a.m.

Later that day, Lim allegedly made a second try to fly to Kuala Lumpur, Malaysia on Malaysia Airlines flight MH 705.

On both occasions, Lim was reportedly denied departure because he failed to secure clearance from the DOJ.

Almeda explained that on that day, there was still no hold departure order (HDO) or warrant of arrest against Lim and that what was in effect was an LBO.

A person placed under an LBO is not allowed to board a plane unless he or she secures a clearance from the DOJ.

“It is called a Lookout Bulletin because you have a pending court case. You have to clear it first with the DOJ prior to departure,” he said.

Last Wednesday, a Makati City regional trial court judge issued warrants of arrest against the siblings in connection with serious illegal detention case filed by Benhur Luy, the principal whistle-blower in the alleged P10-billion pork barrel scam.

BI officials also said that as of early yesterday afternoon, they had no information of departure of Napoles or her brother.

“We have been on alert for these two a few weeks now, even before a warrant of arrest was issued against them. I have long disseminated the information to our seaports all over the country,” Almeda said.
He said immigration officers are under orders to call him or BI officer-in-charge Commissioner Seigfred Mison if the two or either of them make another attempt to leave the country.

With arrest warrants in effect, Napoles and Lim may be arrested on sight and turned over to the National Bureau of Investigation, he said.

Meanwhile, the Manila Prosecutor’s Office will start its preliminary investigation into the perjury case filed by Napoles against whistle-blowers Luy and Merlina Suñas, and Luy’s parents Gertrude and Arturo, and brother Arthur.

De Lima: Flight sign of guilt



“Flight is deemed an admission of guilt.”

Justice Secretary Leila de Lima on Thursday drew this conclusion after Janet Lim-Napoles and her brother Reynald Lim eluded a posse of National Bureau of Investigation agents sent to 28 known addresses of the siblings.

“It’s time for them to face the music and the full arm of the law,” De Lima said, adding that 17 NBI teams were tracking down the siblings.

“Somebody tipped them off,” De Lima said. “Didn’t she brag before that she controls the government?”

Anyone could effect a “citizen’s arrest” in this case because it is “imbued with public interest,” according to De Lima.

Following his rescue in March from three months detention, Benhur Luy, along with five other former workers of Napoles, has accused the businesswoman of masterminding a P10-billion scheme that channeled funds from state agencies and the pork barrel of lawmakers into ghost projects of dummy nongovernment organizations (NGOs) over the past decade.

De Lima told reporters that Napoles and her brother were now regarded as “high-profile fugitives.” She said there would be “no letup” in the manhunt.

30 vehicles
At press time on Thursday, De Lima said the siblings were “mobile” and  “traveling to and from the National Capital Region,” apparently using some of their 30 vehicles, mostly luxury vehicles like a BMW and Cayenne Porsche, to evade arrest. She pleaded to the public to report any sighting of the two.

“If I were in her place, I would surrender and face the case and the other cases,” the justice secretary said.

De Lima was briefed by the NBI on the hunt since a branch of the Makati City Regional Trial Court issued the warrants of arrest for the detention of Luy, whom Napoles said had pocketed P300,000 he was told to deposit in her bank account and also had taken an unauthorized loan of P5 million.

NBI agents failed to find Napoles in her condominium units at Discovery Suites in Ortigas, Pasig City, Pacific Plaza Towers in Bonifacio Global City in Taguig City, residences in Dasmariñas Village and Forbes Park in Makati. In all, the NBI agents staked out in 28 known addresses of the siblings.

There had been reported sightings of the vehicles used by the two but these turned out to be “all negative,” De Lima said.  “The instruction to the NBI teams was no letup in the search.”

De Lima said she informed President Aquino on Wednesday night about the arrest warrants against Napoles and Lim and that the Chief Executive expected the arrests of the siblings “as soon as possible.”

Hold-departure order
She said she had instructed the Bureau of Immigration on Wednesday night to alert personnel in all airports and seaports to arrest Napoles and Lim the moment they show up in any of these places.

“A warrant of arrest is effectively a hold-departure order,” De Lima said, adding the Civil Aviation Authority of the Philippines had likewise been alerted in case the siblings use a private plane to fly out of the country.

She said that those trying to hide the siblings would be liable for harboring fugitives and obstruction of justice.

De Lima said she was not surprised the siblings had evaded arresting officers, given their resources and connections in government. She said she would order an investigation into how the two got wind of the fact that they were to be arrested.

Told that she had announced to reporters the impending arrests, De Lima retorted that the Napoles lawyers were already in court even before the NBI agents got there to receive their directive.

“So why are you blaming me? Are you blaming me?” she asked. “It’s my duty to announce it, especially since some reporters were asking me about it.”

De Lima texted the DOJ beat reporter about the impending arrest. But already at 2:30 p.m., Napoles’ lawyers were already in court, observed an Inquirer informant.

She said Napoles’ lawyers had advance information that the charges against the siblings would be filed by state prosecutors.
 
Probe on scams to go on
With or without Napoles, De Lima said the NBI would continue its inquiry into Napoles’ involvement in the pork barrel scam and the alleged misuse of P900 million from the Malampaya Fund.

“If she continues to be in hiding, continues to be a fugitive, she is deemed to have waived her right to air her side,” she added.

De Lima also defended the decision of Prosecutor General Claro Arellano to approve the reversal of the draft resolution submitted by Assistant State Prosecutor Juan Pedro Navera to dismiss the motion for reconsideration earlier filed separately by the NBI and Luy on the illegal detention case against the siblings.

Arellano ordered a review of the resolution dismissing the detention case penned by Navera, which Arellano himself as prosecutor general had initially approved for lack of probable cause.

“It’s normal that the prosecutor general issues a review resolution,” De Lima said. “If he does not agree with the recommendations, they can come up with a review resolution.”

The 17-page review resolution dated Aug. 6 penned by Senior Deputy State Prosecutor Theodore Villanueva granted the motion for reconsideration filed by the NBI and Luy and ordered that Navera’s resolution dated dated June 10 be reversed. Villanueva also ordered the filing of a serious illegal detention case against Napoles and Lim in court.

Villanueva’s review resolution, which gave more weight to the testimonies of Luy and the NBI, held that Luy had been deprived of his liberty by Napoles and Lim “in the guise of putting him on a spiritual retreat.”

Villanueva said Luy was detained for three months and Napoles had knowledge of this because he was kept at Bahay San Jose, a church residence for priests with whom “she has close ties.” Lim was held liable for carrying out the orders of his sister. Villanueva said it was “highly improbable” Lim would act against his sister.

“The most damning link between the crime and respondent Janet Lim-Napoles is the motive behind complainant Benhur Luy’s deprivation of liberty. Consistent with our earlier finding that the deprivation was undertaken in order to prevent complainant Benhur Luy from divulging information on JLN Group of Companies’ involvement in the fertilizer fund, Malampaya and PDAF scams, it is clear that respondent Janet Lim-Napoles authored and/or orchestrated this unlawful three-month detention,” Villanueva said.

Report any sighting
After meeting with the NBI, De Lima provided reporters a list of the 30 vehicles that could be used by the siblings in evading arrest. She said she got the list from the whistle-blowers.  Copies of the list were also given to the operators of the north and south expressways.
These vehicles include mostly luxury vehicles such as a BMW, Cayenne Porsche, Hummer, Mercedes-Benz, Toyota Alphard and two Ford F-150s.

De Lima said photos of Lim and Napoles would be posted in public places—mainly the series of photographs taken by the Inquirer during her visit to the newspaper last week.

12 NBI teams fan out with Napoles dragnet



Law enforcement authorities are tracking down the whereabouts of suspected PDAF scam brains Janet Lim-Napoles and her brother Reynald Lim.

The suspects remain at large as they refuse to give themselves up after the arrest order came out.

They face charges for the alleged abduction and illegal detention of the pork barrel scam whistle blower, Benhur Luy.

At least 12 teams from the National Bureau of Investigation have been formed to hunt down the fugitives.

All regional and field offices have also been alerted, and an NBI Operations Center has been set-up to receive possible leads regarding the whereabouts of the suspects.

Department of Justice Secretary Leila De Lima said she is not surprised that Napoles got wind of the arrest order even before it was announced, considering her purported web of connections in the government.

Napoles arrest ordered



Justice Secretary Leila de Lima on Wednesday night said National Bureau of Investigation agents were set to arrest Janet Lim-Napoles and her brother for the alleged serious illegal detention of Benhur K. Luy, principal whistle-blower in a P10-billion racket the businesswoman had allegedly masterminded.

De Lima said in a text message to reporters that warrants of arrest were issued by a branch of the Makati City Regional Trial Court against Napoles and her brother Reynald “Jojo” Lim who had allegedly detained Luy for three months until he was rescued by an NBI team last March.

“NBI team on its way to implement arrest warrant,” said De Lima. The offense is nonbailable, she said.

But Napoles was apparently tipped off because by 2:30 p.m. before the arrest warrant was issued, her lawyers were already observed in court, an informant told the Inquirer.

Another Inquirer source said the NBI had supposedly traced her whereabouts in the south of Manila.

The rescue of the 31-year-old Luy was prompted by a complaint by his parents, Arturo and Gertrudes, who said that their son had been detained since Dec. 20.

Acting on the complaint, a special task force of the NBI rescued Luy from an apartment owned by Napoles at the South Garden Condominium Unit, Pacific Plaza Tower, at Bonifacio Global City on March 22.

Upon his rescue, Luy, in an affidavit, said he had been working for Napoles’ JLN Corp., which he said had set up several nongovernment organizations (NGOs) to strike deals with legislators for the liquidation of their pork barrel funds.

De Lima, in a phone interview, said state prosecutors filed the case in court on Tuesday after Prosecutor General Claro Arellano reversed the dismissal of the case by Assistant State Prosecutor General Juan Pedro Navera.

Navera had initially dismissed the case filed by Luy against Napoles and her brother. The NBI filed a motion for reconsideration but Navera affirmed his decision.

In a separate phone interview, Arellano told the Inquirer that he ordered a review of Navera’s resolution. The review was conducted by Senior Deputy State Prosecutor Theodore Villanueva who found probable cause to indict Napoles and her brother.

Arellano said when Luy blew the whistle on Napoles’ alleged involvement in the scam, there was a motive for her to send Luy on a “spiritual retreat” and restrain him there.

Luy said that prior to his detention, Napoles supposedly got wind of his plan to break away from the group. He said Napoles also confronted him about what she suspected were his personal transactions with the Department of Agriculture and was told to undergo an investigation.

He was then brought to Bahay ni San Jose in Makati City, where he was prohibited to use any means of communication. In the course of his detention, Luy said he was able to see his family only twice. He said his family appealed for his release, but this fell on deaf ears.

During the March 22 rescue operation, the NBI arrested Napoles’ brother Reynald Lim, who complained of chest pains and was immediately admitted to St. Luke’s Medical Center for treatment.

On March 23, the NBI recommended to the Department of Justice (DOJ) that both Napoles and her brother be prosecuted for serious illegal detention, or violation of Article 267 of the Revised Penal Code.

On April 15, Napoles, in her counteraffidavit, denied all of Luy’s allegations. Napoles maintained, among other things, that JLN Corp. was in the business of trading goods such as marine supplies and equipment and construction material and never had deals with the government or its agencies.

Napoles said Luy was not her employee but rather her personal assistant who could conduct his own business.

She also accused him of taking out P5 million in loans from a savings and loans on her behalf but without her knowledge, and of pocketing P300,000 that she had asked him to deposit for her in her bank account.

On June 10, a panel of prosecutors from the DOJ recommended the dismissal of the illegal detention complaint after saying that it found that Luy had voluntarily stayed at the retreat house.

On June 25, Napoles filed qualified theft charges against Luy in the Pasig City Regional Trial Court.

On July 9, Judge Danilo A. Buemio of the Pasig RTC Branch 265 issued an arrest warrant for Luy in the case filed by Napoles. The offense was deemed nonbailable by the court.

Luy, however, remains free as he has been admitted provisionally into the Witness Protection Program, putting him under government custody.

Revilla on Napoles case: Leave kids out of it



MANILA – Senator Bong Revilla appealed to the public and the media on Thursday not to involve his son in the controversy surrounding Janet Lim-Napoles, who is alleged to be the mastermind behind the P10 billion pork barrel scam.

The senator admitted that the Revillas and the Napoleses know each other and sometimes meet in social gatherings.

Revilla said his son, Leonard Bryan Bautista, and one of Napoles’ children, James Christopher Napoles, met in high school and eventually became business partners.

The two sold imported rubber shoes under the PB & J Corporation.
Revilla said the business was legitimate.
